Terms and conditions
We are A Network Solutions Ltd, trading as Answer Lah. By ordering any of the Services, you agree to be bound by these Conditions.
We reserve the right to change our terms and conditions policy at any time. However, if any changes do occur, we will publish the changes on our web site that a new terms and condition clause has been implemented.
GENERAL
We will use reasonable care and skill in our services provided.
On certain type of services, we may require to visit the site to enable us to give a more accurate quote. Quotations will be valid for 14 days from its date, unless we withdraw it at an earlier time.
Once you accept the quote, a contract will be given to you. No variations of the contract can be made (after the services have started) unless the variation has been agreed by the customer and the supplier in writing.
If the services requested prove to take longer than estimated/quoted due to unforeseen circumstances, the client will be charged accordingly at a cost that is agreed between both parties.
Once the Services are completed, the client will check and acknowledge on the services carried out, thereby accepting that the job has been done to standard.
CUSTOMER RESPONSIBILITIES
You will be responsible for preparing the area for the supply of our services, including not limiting to removing any items, covering any items, which you will not be moving, to protect them from dust or dirt, as well as for securing or removing any valuables, breakables. If you wish for us to carry out the protection of your items, we do charge an additional fee.
You shall provide all necessary electricity/water supplies that might be required to carry out our services.
We are not liable for any delay or failure to fulfill our services if this is caused by your failure provide the necessary actions of this section.
PAYMENT
We will invoice you for payment of the fees either:
before we provide the services; or
when we have completed the services; or
on the due date stated in the invoice.
For project contracts, if you do not pay within the due date, we will charge you 4% per annum above the base lending rate until payment is received in full. All payments due must be made in full without any deduction or withholding. We may also suspend any further provision of the Services and cancel any future services which have been ordered by you.
We can terminate further of our services immediately if you fail to make pay any amount due under the contract;
SUB-CONTRACTING AND ASSIGNMENT
We can at any time assign, subcontract or delegate in any manner any or all of our obligations to any third party.
LIABILITY AND INDEMNITY
The total amount of our liability is limited to the total amount of fees payable by you under the Contract.
We are not liable for:
- any indirect loss, damage, costs, or expenses;
- any loss of profits; loss of business; loss of data; loss of reputation or goodwill; business interruption; or, other third party claims;
- any failure to perform any of our obligations if such delay or failure is due to any cause beyond our reasonable control;
- any losses caused directly or indirectly by you.
You will indemnify us against all damages, costs, claims and expenses suffered by us arising from any loss or damage to any equipment (including that belonging to third parties) caused by you or your agents or employees.
Neither of us are liable for any failure or delay in performing our obligations from any cause that is beyond our reasonable control. Such causes include, but are not limited to: acts of god, power failure, Internet Service Provider failure or any other event. If the delay continues for a period of 90 days, either of us may terminate or cancel the Services to be carried out under these Conditions.
DATA PROTECTION
When supplying services to you, we may gain access to and/or acquire the ability to transfer, store or process personal data of employees. We will not keep any personal data longer than necessary and refrain from using the information for any third party’s purposes.
